TERMS AND CONDITIONS

  • The Company ‘Rio Montanha Ecotourismo’ works in accordance with the Brazilian law.
  • The prices indicated by the Company on its website or publications are in Brazilian Real, except if indicated otherwise, and are subject to change without prior notice. Currency exchange conditions may apply. 
  • The Client certifies to be mentally and physically fit to practice the activities, and that their participation is voluntary.
  • Expeditions, hiking and adventure tours are not recommended for people with a history of heart or lung disease.
  • Tours classified as moderate and difficult are not suitable for children.
  • Children under the age of 18 may participate in the tours; however, a written permission of the parent or guardian, who must also accompany the minor at all times, is required.
  • Children under the age of 18 may not participate on expeditions.
  • When the Client submits their Booking Form, they agree and accept each and every one of the terms and conditions detailed herein, and warrant that all information provided is complete and true.

Expeditions:

  • The Company declines all liability if the Client, by any authority, does not have its entry accepted in the country of the expedition, whether due to non-compliance with any of the essential requirements, defects in the passport, or any other circumstance. The Company declines all coverage in these cases, and the Client will bear any expense arising from the foregoing and similar reasons.
  • The itinerary of expeditions is budgeted with group services in order to offer them at a lower cost. If the Client needs to leave the expedition for any reason (personal, illness, among others), the expenses are their responsibility.
  • It is in the nature of this type of expedition to be flexible to change. The daily itinerary and coordination details are considered as an objective to be fulfilled, not as contractual obligations. It is a necessary condition for joining the Company’s expeditions that the Client accepts this flexibility.
  • The Company is not responsible for delays or changes to the itinerary for causes such as (but not limited to) adverse weather conditions, loss of luggage on airlines, flight cancellations, strike, or any other force majeure.

Cancellation Policy:

  • The Booking will only be confirmed upon payment of the Booking Fee.
  • The Client may cancel the Booking, upon written notice by email or WhatsApp, by:
    – City Tours, Hiking and Adventure Tours: up to 7 days before the tour date;
    – Expeditions: up to 30 days before the start date of the expedition.
  • The Booking Fee is not refunded after this period.
  • The Booking Fee is not refunded in case of no-show.
  • The Company reserves the right to cancel the tour or expedition or change its itinerary and date, at any time, due to force majeure, adverse weather conditions, when the minimum number of participants required is not met, or if the tour guide(s) deems it necessary to ensure the physical integrity and safety of the Client and the group as a whole. In these cases, the cancellation or alteration will be informed to the Client, who may choose to reschedule the date (except for international expeditions), request a refund of the amount paid, or transform it into a credit that can be used for other services offered by the Company.
  • In all cases, the Client waives any claim for economic compensation.
  • If the Client wishes to change a Booking that is already confirmed, they must do so by written notice via email or WhatsApp up to 3 days before the tour date, in case of City Tours, Hiking and Adventure Tours, or up to 30 days before the start date, in case of Expeditions.

Risk Knowledge:

  • The Company ‘Rio Montanha Ecotourism’, as well as its tour guide(s), are released from any liability. The Client assumes all liability, including medical expenses for personal injuries, damage and/or death related to the participation in the activities.
  • The Client is fully aware of and accepts the risks inherent to the activities, including, but not limited to:
    – Slips, abrasions, scratches, dehydration, heat stroke, drowning, bites of insects or venomous animals, among others;
    – Minor, mild and/or serious injuries, and/or death by accident, equipment failure, or by non-compliance with the instructions of the Company and its team;
    – Damage or loss of equipment and personal belongings, such as cameras, phones, prescription glasses, among others, used during the activity.
  • The Client declares to be in good health and to have informed about any relevant medical condition. The Company is not responsible for incomplete and/or incorrect information provided by the Client. 
  • The Client understands that, when necessary, the use of safety equipment provided by the Company is mandatory, and is aware that any of their actions that goes against the instructions of the Company or its team may cause damage to their physical integrity, to the environment and to third parties, to which they assume full responsibility.
  • In case of expeditions, the Client is fully responsible for bringing their own appropriate equipment and clothing, which will be reviewed by the tour guide(s) on the first day of expedition. The Company provides trained personnel to inform and advice the Client on the choice of equipment.
  • The decisions made by the tour guide(s) are final. If the tour guide determines that a behavior, physical condition, or any other reason caused by the Client represents a risk to the safety, health, or welfare of the Client themselves or the group as a whole, the Client will be asked to leave the activity, not being entitled to reimbursement of any kind.

Authorization for Use of Image:

  • The Client authorizes in advance the use of their image, in photos and/or videos taken during the activity with the Company, on its website and social media and for promotional purposes, and the Client cannot claim any rights and/or payments.

‘Rio Montanha Ecotourism’, in its digital media, is aimed at the general public and users of all ages. The Company undertakes, in accordance with current legislation, to guarantee the privacy of the users of this website. To this end, it expressly declares that it does not have any mechanisms that personally identify users and/or their respective electronic addresses without the voluntary provision of these data.
This Privacy Policy applies to the collection, use and disclosure of Personal Information on the website and in all services offered by the Company.

  • This website uses SSL protocol on all pages that ask for the Client’s personal and confidential data.
  • Use of Information: The Company will not disclose to third parties any information that result in the personal identification of its users, except when they give permission to do so. “Personal Information” are the information provided that personally identifies the users, including, for example, their full name, phone number, and email address. Personal Information is obtained when users submit a request through this website or other means. This information is used to send information requested by users or for administrative reasons (such as to communicate about changes made to a tour). None of the data stored will be disclosed without the express authorization of its holder. These data are filed in accordance with current Brazilian legislation and for the duration of the provision of services.
  • Cookies: The Company hereby declares that it counts the number of visits to this website and its underlying pages, including through the use of cookies, in order to improve the quality of the services provided. Statistical and generic analyses of the behavior of users may be shared, but the user will never be individually identified.
  • Information Security: The Company has implemented and follows measures and standards to protect against unauthorized access and interception or processing of Personal Information, including secure connection mechanisms. 

  • Changes to the Privacy Policy: The Company may change this Privacy Policy from time to time, and suggests that the user visit this page frequently to keep up-to-date.
